1. Acceptance of Terms

By downloading, installing, or using SmartestIPTV (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

SmartestIPTV is a media player application that enables users to play IPTV streams from user-provided sources. The App does not include any pre-loaded content, channels, or streaming sources. Users must provide their own IPTV playlist URLs or Xtream Codes credentials.

3. User Responsibilities

You agree that:

• You are solely responsible for the content you access through the App.
• You will only use the App to access content for which you have legal authorization.
• You will comply with all applicable local, state, national, and international laws and regulations.
• You will not use the App for any unlawful purpose, including but not limited to accessing pirated or unauthorized content.
• You will not attempt to reverse engineer, decompile, or disassemble the App.

4. Subscriptions and Payments

SmartestIPTV offers a free tier and paid Pro plans (Annual and Lifetime). Paid subscriptions are processed through the respective platform's payment system (Apple App Store, Google Play, etc.). Refund policies are subject to the respective platform's terms. We offer a 7-day money-back guarantee for direct purchases.

5. Intellectual Property

The App, including its design, code, graphics, and user interface, is the intellectual property of SmartestIPTV and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without prior written consent.

6. Limitation of Liability

SmartestIPTV is provided “as is” without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free operation of the App. In no event shall SmartestIPTV be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

7. Content Disclaimer

SmartestIPTV does not control, endorse, or assume responsibility for any third-party content accessed through the App. We are not responsible for the quality, accuracy, legality, or appropriateness of any content streamed through the App.

8. Account Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately.

9. Changes to Terms

We may modify these Terms at any time. Continued use of the App after modifications constitutes acceptance of the updated Terms. We will notify users of significant changes through the App or by email.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles.

1. Information We Collect

We collect minimal information necessary to provide our service:

• Account information: Email address and authentication data when you create an account (required for Pro features).
• Usage data: Anonymous app usage analytics (e.g., feature usage, crash reports) to improve the App. This data cannot be used to identify you.
• Cloud sync data: If you use cloud sync (Pro feature), we store your favorites, watch history, and app settings in encrypted form.

2. Information We Do NOT Collect

• We do not collect, store, or log your IPTV playlist URLs or content.
• We do not track which channels or streams you watch.
• We do not sell your personal data to third parties.
• We do not use advertising SDKs or tracking pixels.

3. How We Use Your Information

• To provide and maintain the App.
• To sync your data across devices (Pro users).
• To process payments and manage subscriptions.
• To send important updates about the App (you can opt out).
• To improve the App through anonymous analytics.

4. Data Security

We use industry-standard encryption (AES-256) for data at rest and TLS 1.3 for data in transit. Cloud sync data is encrypted before leaving your device. We follow security best practices and conduct regular security audits.

5. Data Retention and Deletion

You can delete your account and all associated data at any time from within the App. Upon account deletion, all your data is permanently removed from our servers within 30 days. Anonymous analytics data is retained for up to 12 months.

6. Third-Party Services

The App may integrate with third-party services (e.g., payment processors, analytics providers). These services have their own privacy policies. We use AWS for cloud infrastructure and RevenueCat for subscription management.

7. Children's Privacy

The App is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13.

If you are in the European Economic Area, you have the right to:

• Access your personal data.
• Rectify inaccurate personal data.
• Request deletion of your personal data.
• Object to processing of your personal data.
